Sub: Objection and Notice against Arbitrary and Unlawful Circular on Proposed Revision in Maintenance Charges by Enviro in August 2024 in violation of the terms of the Maintenance agreement.

Sir,

1. The undersigned resident strongly opposes the implementation of Circular on Proposed

Revision in Maintenance Charges issued by Enviro in August 2024 as is arbitrary and unlawful. Revision and increase in the maintenance charges without having any discussion, inviting suggestion from the resident based on unverified, frivolous and unaudited expenses is absolutely unjust and illegal.

2. You have illegally and arbitrarily increased the maintenance charges despite the fact you have been continuously failing to maintain the entire premises. The common areas are not cleaned regularly, you have kept untrained security guards resulting in security lapses on daily basis. Water supply is often contaminated, sewerage blockages are resulting in health hazards. Internal roads and pavements are damaged due to poor upkeep and negligent drainage. Poor upkeep of vacant units is resulting choked drains resulting in extreme seepage for fellow residential units. Common area lights are damaged and faulty. Garden and green spaces are not being maintained and landscaping have been destroyed. Your local staff manipulate the feedback forms about services and maintenance from residents.

3. As per the maintenance agreement, “the maintenance charges cannot be increased more than the 05% (Five percent) over and above the preceding Maintenance charges.” You have revised the amount which is way beyond and more than the agreed 05% increase of last preceding maintenance which illegal and unjust. You are under obligation to consult, discuss and take in confidence the resident before revising any charges or services.

4. You have violated the terms of the agreement by merely relying on your P&L. Despite requesting your official several times orally, you have never shared Enviro’s audited accounts about your operational expenses with resident. You have never provided details about exact calculations of all the escalation factors used by you to revise charges. You keep mentioning about financial challenges but have always evaded sharing complete account details and information despite giving several assurances for which you are under legal obligation to provide. Your actions have resulted in acute trust deficit due to non-transparent way of operating.

5. Also, due to dual energy meter installed, any amount deducted by you from the online meter account shall be done against the wish and without the consent of the resident being payment being forcibly collected under protest and same shall be adjusted and recovered from you accordingly.

Therefore, you put are hereby put on notice, informed and requested to immediately withhold your Arbitrary and Unlawful Circular on Proposed Revision in Maintenance Charges by Enviro in August 2024 till further notice until you share in writing the all the Audited Accounts including P&L of Enviro for Vatika Infotech City Jaipur along with all Escalation factors, formulae used for calculations, Advice taken from financial consultants for said, Complete details resulting in this Circular on revision of maintenance charges.

Also, any increase in maintenance charges if required to be revised shall be done only after duly deliberating on pressing needs after discussions with resident. Failing which you shall be subjected to all appropriate legal action. And, if you fail to reply as aforementioned to this email, it shall be deemed on your part that you have violated the terms of maintenance agreement and the resident shall not be under any legal obligation to pay revised amount and the aforesaid circular shall be deemed withdrawn on your part.
